Terms of use.
The deal between you and us, in as few words as we can manage.
Agreeing to this
Installing or playing Pen Fire means you accept these terms. If you do not accept them, do not install the game, and delete it if you already have.
These terms are between you and Flower Execution Limited, a company registered in the Hong Kong Special Administrative Region. Where we say we, us or our, that is who we mean.
Who can play
Pen Fire is rated 9+ and anyone can play it. What you cannot do without help is agree to a contract: if you are under 18, a parent or guardian has to accept these terms for you, and they are responsible for what happens on the account the game is installed under.
You also need to be old enough to hold an account on the store you install from, which sets its own minimum.
Your licence to play
We give you a personal, non-exclusive, non-transferable licence to install and play Pen Fire on devices you own or control, for your own enjoyment and not commercially. That licence is all you get: we are not selling you the game itself.
You may not rent, sell, sublicense or redistribute the game, and you may not take it apart, decompile it or work around the technical limits in it, except where the law says you may do so regardless of what a contract like this claims.
Purchases
Fighters, crowns, the season pass and bundles are digital items sold through the App Store and Google Play under that store's terms. Prices are shown before you buy. Crowns have no cash value, cannot be exchanged for money, and cannot be transferred. Loot boxes on the season track show their odds in the game before you open them.
What you buy is a licence to use that item inside Pen Fire, for as long as we run the game. It is not property, and it does not survive the game.
Refunds are handled by the store you bought from, not by us, and under that store's policy. Restoring a purchase requires the same store account. Where consumer law gives you a right to cancel, that right stands whatever this page says, though buying a digital item you can use immediately usually ends it.
Your progress
Progress is stored on your device. We do not keep a copy, so we cannot recover progress from a deleted app or a lost phone. Purchases can be restored; crowns already spent cannot.
Fair play
Do not modify the game, its saves or its purchases, and do not use tools that do. Do not use bots, exploits or anything that fakes progress or purchases. Be decent to the people you play with: no harassment, no slurs, no impersonating us.
If you break the rules
We may remove features such as friends and multiplayer from your copy, or stop you using the online parts of the game, if you break the fair play rules. We will match what we do to what happened, and where it is practical we will tell you why.
This does not refund purchases, and it does not stop you playing offline.
Ownership
The game, its characters, art, code, sound and name belong to Flower Execution Limited. Buying a fighter gives you a licence to play as it, not ownership of it.
Videos and streams
You are welcome to record, stream and share your play, including on channels you make money from. You do not need to ask. The two conditions are that you do not present it as made or endorsed by us, and that you do not use our name or art to sell something that is not the game.
What you record is yours. We claim nothing in it.
Changes and endings
We will keep updating Pen Fire: balance, content, seasons. Seasons end on their dates and their rewards go with them. If we ever stop publishing the game, we will say so in advance in the game's news, and what you have downloaded keeps working offline.
We may change these terms. If a change matters to you, we will put it in the game's news rather than quietly moving the date at the top of this page. Carrying on playing after a change means you accept it; if you do not, stop playing and delete the game.
No warranty
Pen Fire is provided as it is. We work hard on it, but we do not promise it will be free of bugs, uninterrupted, or able to run on every device.
Nothing here takes away the rights consumer law gives you where you live. If your country says a digital product must be of satisfactory quality and fit for purpose, it must, and this paragraph does not change that.
Where our liability stops
To the extent the law allows, we are not liable for indirect or consequential loss, lost data, lost progress, or loss of the time you put into the game. Where we are liable, our total liability to you is limited to what you have actually paid us for Pen Fire in the twelve months before the claim.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.
Apple and Google
If you installed Pen Fire from the App Store, this agreement is between you and us only. Apple is not a party to it. Apple has no obligation to provide support for the game, and if it fails to match any warranty, you can tell Apple and Apple will refund the purchase price; beyond that, Apple has no warranty obligation. Any other claim about the game, including product liability, a failure to meet a legal requirement, or a claim under consumer protection law, is ours to answer, not Apple's. If a third party claims the game infringes their intellectual property, we handle it. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.
You also confirm you are not in a country under a United States embargo or on a United States prohibited-parties list, which is a condition Apple requires us to pass on.
If you installed from Google Play, the same principle applies: your agreement is with us, and Google's own terms govern your relationship with Google.
Law and disputes
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the Hong Kong courts have jurisdiction over any dispute.
If you are a consumer somewhere else, this does not take away the protection of the mandatory laws of the country you live in, or your right to bring a case in your local courts where the law gives you one.
The rest
If a court finds one part of these terms unenforceable, the rest carries on. If we do not enforce something straight away, we have not given up the right to. These terms, plus the store's own terms and our privacy notice, are the whole agreement about Pen Fire.
